Terms of Use

1. Acceptance of Terms

By accessing or using ManaBurned at manaburned.com ("the Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Service.

These Terms apply to all visitors and users. We may update them at any time by posting the revised version on this page with a new "Last updated" date. Continued use after an update constitutes acceptance of the new Terms.

2. What ManaBurned Is (and Isn't)

ManaBurned is an independent price comparison tool for Magic: The Gathering singles. It aggregates publicly available product listings from game stores across Canada and the United States and displays them in one place.

ManaBurned is not:

• A retailer or marketplace — we do not sell cards
• An agent or broker for any store
• Affiliated with, endorsed by, or in partnership with any listed store
• Affiliated with Wizards of the Coast, Hasbro, or any other card game publisher
• Responsible for the accuracy, availability, or reliability of any price or listing

When you click a store link on ManaBurned, you leave our site and enter a transaction with that store directly, under their terms and policies. ManaBurned is not a party to that transaction.

3. Price Data — Accuracy and Limitations

Prices on ManaBurned are sourced automatically from public store websites. By their nature, they may be:

• Stale: Store inventory changes constantly. A price shown may no longer reflect the store's current listing.
• Inaccurate: Data parsing errors, currency conversion rounding, or store website changes may produce incorrect prices.
• Out of stock: A listing may appear in stock when the item has already sold.
• Condition-mismatched: Card condition grading varies by store and may not match the condition displayed.

Always verify the current price and availability directly on the store's website before making a purchase decision. ManaBurned makes no warranty, express or implied, as to the accuracy, completeness, or timeliness of any price data.

4. No Purchases Through ManaBurned

ManaBurned does not process payments or facilitate purchases. All buy links redirect you to the store's own website. Your purchase is solely between you and that store. ManaBurned accepts no liability for any transaction, dispute, shipping issue, or product quality concern arising from a purchase made through a link on our site.

5. Store Listings

ManaBurned lists stores based on publicly available information. Inclusion of a store in our database is not an endorsement, recommendation, or guarantee of that store's quality, reliability, or business practices. Removal requests from store owners may be submitted to contact@manaburned.com.

6. Intellectual Property

The ManaBurned name, logo, website design, original written content, and software code are the intellectual property of ManaBurned and may not be reproduced, distributed, or used without our express written permission.

Magic: The Gathering card names, set names, card artwork, mana symbols, and other game elements are the intellectual property of Wizards of the Coast LLC, a subsidiary of Hasbro, Inc. We use these solely for the purpose of card identification in a price comparison context. See our IP Disclaimer for details.

7. Prohibited Uses

You agree not to:

• Use automated scripts, bots, crawlers, or scrapers to systematically access, copy, or harvest data from ManaBurned without our prior written permission
• Use the Service for any unlawful purpose or in violation of any applicable law or regulation
• Attempt to gain unauthorized access to any part of our infrastructure
• Interfere with or disrupt the operation of the Service or its underlying servers
• Republish, resell, or commercially exploit ManaBurned data without authorization
• Use the Service in a way that could damage ManaBurned's reputation or harm users

We reserve the right to block access to any user or IP address that violates these prohibitions.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any information on the Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MANABURNED, ITS OPERATORS, AND CONTRIBUTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total aggregate liability to you for any claim arising from these Terms or your use of the Service shall not exceed CAD $100.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so the above limitations may not fully apply to you.

10. Third-Party Links

ManaBurned links to third-party store websites. We have no control over those sites and are not responsible for their content, privacy practices, or terms of service. Visiting a linked store is at your own risk.

11. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the federal laws of Canada, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the Service shall be resolved by the courts of competent jurisdiction in Canada. You agree to submit to the personal jurisdiction of those courts.

12. Changes to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time without notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuance.
